Minutes of Meeting of October 6, 2004
Town Hall Hearing Room
Present:        R. Dennis O'Connell, Chair; Lisa Brown, Ben Gitlow, Harriet Miller, Gerald Parent, Alfred Pickard

Excused:        Mark Berry; Rex Peterson, Assistant Town Administrator

Chair O’Connell called the meeting to order at 7 p.m. He turned the chairmanship over to Lisa Brown for the discussion of the Rinzler ANR.

ANR 04-09
Chair O’Connell recused himself as a Wellfleet Conservation Trust abutter of the property; Harriet Miller disclosed that she lives in the neighborhood of the subject property.  Chet Lay, representing Deborah Rinzler,  presented ANR 04-09 plans for 130 Moses Hinkley Way (Map 29, Lot 287).  Lot A will be sold to the Town or the Wellfleet Conservation Trust, which has a binder on the sale.  The purchase of the property is a warrant article for Special Town Meeting.  Lay assured the Board that there would be no change in the access road to Mrs. Rinzler’s house.
Gerald Parent made a motion to approve the ANR.  Ben Gitlow seconded.
The Board voted to approve the ANR 5-0.

Other Business
With Chet Lay still in attendance, Chair O’Connell read an e-mail from Mr. Lay to Rex Peterson regarding the McClellan v. Chechelnitsky case. Gerald Parent recused himself from the table.  New buyers of the McClellan property have no problem with the 14% grade for the road.  This was already approved by the Planning Board.  No action was needed.

Community Preservation Act
The Board reaffirmed its 6-0 vote to recommend the CPA warrant article for Special Town Meeting.  Ben Gitlow asked if the new CPA Committee would have to be included in the Charter.  This committee, the Open Space Committee and any others that are not in the Charter could be added to it.

Minutes
Lisa Brown moved that the amended minutes be approved; Gitlow seconded.
The Board voted to approve 5-0-1.

The correspondence file included:
An e-mail to Rex regarding the Paulick case
ZBA notice of W.H.A.T.’ s withdrawal of Special Permit request for temporary tent
ZBA approval of the Sexton’s condo conversion of Surfside Colony
Request for volunteers at the Oyster Festival

New Business
Lisa Brown felt there should be a Planning Board liaison to ZBA for special cases such as the W.H.A.T. and volunteered herself for the task.  Chair O’Connell accepted.

Adjournment
Ben Gitlow made a motion to adjourn; Lisa Brown seconded; all approved 6-0.
The meeting adjourned at 7:40 p.m.
